A general principle of European Union law set out in Art. 47 of the Charter of Fundamental Rights of the European Union which gives everyone whose rights and freedoms guaranteed by EU law are violated the right to an effective remedy before a national authority or tribunal notwithstanding that the violation has been committed by persons acting in an official capacity.
