Note(s)

1. The EES aims to improve the management of external borders, to reduce irregular migration by addressing the phenomenon of overstaying, and to facilitate the management of migration flows. In addition, it aims to contribute to the fight against terrorism and serious crime and to ensure a high level of internal security.
2. The EES applies to third-country nationals, both those requiring a visa and those visa-exempt, admitted for a short stay of 90 days in any 180-day period. It also applies to those that have been refused entry. It stores information on their identity and on their travel documents , as well as certain biometric data .
3. The Regulation determines the conditions of access to the system for law enforcement purposes. The information stored in the EES is accessible to border authorities, visa authorities and the authorities within the Schengen Member States competent to check if a third-country national fulfils the conditions of entry or stay. The data are also available to the designated authorities and Europol , to prevent, detect and investigate terrorist offences or other serious crimes, according to conditions as set out in the regulation.
