1. The United Nations High Commissioner for Refugees (UNHCR) refers in its Executive Committee Conclusion No. 30 that procedures for applications considered to be manifestly unfounded should include necessary procedural safeguards including preliminary counselling in an appropriate language; full personal interview by an qualified official; responsibility of the competent asylum authority for establishing the manifestly unfounded character of the application; ability to seek review of negative decisions.
2. The further circumstances according to Art. 31(8) c- i of Directive 2013/32/EU (Recast Asylum Procedures Directive) are:
c) the applicant has misled the authorities by presenting false information/documents or by withholding relevant information/documents with respect to their identity and/or nationality that could have had a negative impact on the decision;
d) it is likely that the applicant has, in bad faith, destroyed or disposed of an identity or travel document that would have helped establish their identity or nationality;
e) the applicant has made clearly inconsistent and contradictory, clearly false or obviously improbable representations which contradict sufficiently verified country of origin information (COI), thus making their claim clearly unconvincing in relation to whether they qualify as a beneficiary of international protection;
f) the applicant has introduced a subsequent application for international protection that is not inadmissible
g) the applicant is making an application merely in order to delay or frustrate the enforcement of an earlier or imminent decision which would result in their removal;
h) the applicant entered the territory of the EU Member State unlawfully or prolonged their stay unlawfully and, without good reason, has either not presented themselves to the authorities or not made an application for international protection as soon as possible, given the circumstances of their entry;
i) the applicant refuses to comply with an obligation to have their fingerprints taken in accordance with Regulation (EU) No 603/2013 (Eurodac-Regulation) for the comparison of fingerprints for the effective application of Regulation (EU) No 604/2013 (Dublin III Regulation).
2. Applications for international protection in the above circumstances that are defined under national legislation as ‘manifestly unfounded’ may be considered under accelerated procedures and/or conducted at the border or in transit zones, in accordance with the basic principles and guarantees set out in Chapter II of the Recast Asylum Procedures Directive. According to Recital 21 of the same Directive false documents, lack of documentation or inconsistent statements would not necessarily mean that an application is manifestly unfounded or would not meet the criteria for granting international protection.
