1. These provisional measures are envisaged under Art.78 (3) of the Treaty on the Functioning of the European Union
2. Under the distribution mechanism the receiving EU Member State will be responsible for the examination of an application for international protection in accordance with established rules and guarantees. The EU Commission has defined a redistribution key based on criteria such as GDP, size of population, unemployment rate and past numbers of asylum seekers .
3. The European Union Agency for Asylum (EUAA) uses the term ‘contingency plan’ to refer to national plans detailing special measures to be taken in the event of a mass influx of migrants . This may be limited to the national asylum system or to migrants more generally.
4. Art. 33 of Regulation (EU) No 604/2013 (Dublin III Regulation) provides for two types of Member State emergency responses: “preventative action plans”, which should be operationalised when particular pressure on a Member State’s asylum system and/or problems in its functioning may jeopardise the application of the Dublin Regulation, and 'crisis management action plans', which should be operationalised if the 'preventative action plan' does not remedy the problem.
