1.This movement is without the prior consent of the national authorities, it can be with (legal entry but then stay beyond the allowed duration) or without an entry visa; it can be with or with no or insufficient documentation normally required for travel purposes, or with false or fraudulent documentation.
2. In the European Union, the Dublin III Regulation (Regulation (EU) No 604/2013) aims at avoiding secondary movement of applicants for international protection between different EU/EFTA Member States. Art. 3(1) of the Regulation establishes that an application for international protection should be examined by a single EU Member State, to be determined under the responsibility criteria as set out in Chapter III of the same Regulation.
