Seasonal worker in Slovenia

Are you a non-EU citizen wishing to carry out seasonal work in Slovenia? You can find information below on the conditions, procedures and rights you can enjoy during your stay.

Conditions

To carry out seasonal work in the agriculture and forestry sector for up to 90 days in a calendar year, you must obtain a permit for seasonal work. Seasonal work shall be inherently linked to a season characterised by a significant labour demand increase in the activity concerned.

To carry out seasonal work longer than 90 days in a calendar year, you must obtain a single residence permit for seasonal work longer than 90 days (hereinafter: single permit for seasonal work).

Procedures

Where and how to apply

1. Permit for seasonal work for up to 90 days

Application submitted by the employer or hirer

An employer or hirer may apply for the permit for seasonal work for up to 90 days at the Employment Service of Slovenia.

Application form

An application for the issuance or renewal of the permit for seasonal work for up to 90 days shall be made using the form available at web site of Employment Service of Slovenia.

2. Single residence permit for seasonal work longer than 90 days

An application to obtain a single permit for seasonal work may be submitted by you or your employer.

Application submitted by you

You must apply for a first single permit for seasonal work at a diplomatic mission or consular post of the Republic of Slovenia abroad.

Application submitted by the employer

Alternatively, your employer may apply for a first single permit at a diplomatic mission or consular post of the Republic of Slovenia abroad or at the administrative unit in the area where the employer is established or where the activity is performed in the Republic of Slovenia.

Application form

An application for the issuance or renewal of a single permit for seasonal work shall be made using the form no. 16/1 set out in Annex 1 of the Rules on the method of issuing a residence permit and a certificate on the rights of a frontier worker, the method of capturing fingerprints, the method of marking termination and the price of a residence permit card and a certificate on the rights of a frontier worker.

The application form is also available at a diplomatic mission or consular post of the Republic of Slovenia abroad or at the administrative units in Slovenia.

Fees

1. Permit for seasonal work for up to 90 days

The administrative fee for issuing the permit for seasonal work for up to 90 days is 50 euros. For the issuance and renewal of a permit for seasonal work in agriculture, it is necessary to pay a fee under the Administrative Fees Act. It is paid by the employer who submits the application.

2. Single residence permit for seasonal work longer than 90 days

The administrative fee for issuing a first single residence and work permit is 102 euros, if the application is lodged at a diplomatic mission or consular post of the Republic of Slovenia abroad.

The administrative fee for issuing a single residence and work permit is 70 euros, if the application is lodged at the administrative unit in the Republic of Slovenia.

The price of the residence permit card is 12 euros.

Documents required

1. Permit for seasonal work for up to 90 days

To obtain the permit for seasonal work for up to 90 days, you must submit to the Employment Service of Slovenia a form with the following information:

  • applicant information;
  • a third-country national data;
  • type, place and time of seasonal work.

2. Single residence permit for seasonal work longer than 90 days

To obtain a single permit for seasonal work, you must submit to the administrative unit:

  • a personal photography;
  • a valid travel document or a certified photocopy of the travel document that is valid for at least three months beyond the intended residence in the Republic of Slovenia;
  • proof of adequate health insurance covering at least emergency medical services in the Republic of Slovenia, when you state that you are not compulsorily insured in the Republic of Slovenia;
  • proof of sufficient means of subsistence during residence in the country, or other guarantees that means of subsistence will be provided, every month, in an amount corresponding to at least the basic minimum income in the Republic of Slovenia (more information about sufficient means of subsistence);
  • an employment contract signed by the employer or a civil law contract signed by the contractor;
  • a certificate from the criminal record of your home country.

Further requirements

1. Permit for seasonal work for up to 90 days

In order the permit for seasonal work for up to 90 days to be issued, the following conditions must be met:

  • the third-country national has a valid passport (validity must be at least three months beyond the intended period of residence in the Republic of Slovenia);
  • the third-country national has adequate health insurance;
  • there are no suitable unemployed persons in the register of unemployed persons;
  • the employer or hirer is appropriately registered as an employer or hirer, entered in the Business Register to peruse the activities in which the third-country national is to carry out work, or is entered in the Register of Agricultural Holdings as the head of an agricultural holding or a member of a farm household;
  • an employment contract signed by the employer or a civil law contract signed by the hirer is submitted;
  • the employer is not in liquidation or bankruptcy proceedings;
  • the employer has settled tax liabilities from work or employment;
  • the annual quota of seasonal work permits, which can be set by the Slovenian government due to the limitation of the number of third-country nationals on the labour market, has not yet been reached.

2. Single residence permit for seasonal work longer than 90 days

A third-country national with a valid temporary residence permit or long-stay visa who does not reside with an accommodation provider or host shall register temporary residence at the address where he or she temporarily resides with the administrative unit within eight days of the day of taking up temporary accommodation, while a third-country national who already resides at the address and obtains a temporary residence permit or long-stay visa after taking accommodation at this address shall register within eight days of its service.

Duration of validity of permits

1. Permit for seasonal work for up to 90 days

The total duration of one or more valid seasonal work permits performed by the third-country national with the same or another employer or client may not exceed 90 days in a calendar year.

2. Single residence permit for seasonal work longer than 90 days

A single permit for seasonal work longer than 90 days shall be issued for the period of the employment or work contract with the same employer or contractor and may be extended, while the total duration of seasonal work must not exceed six months or, in exceptional cases determined in the Act governing the employment and work of foreigners, seven months in a calendar year.

Conditions for renewal

1. Permit for seasonal work for up to 90 days

The seasonal work permit may be renewed if:

  • the employer applies for an extension of the seasonal work permit before the expiry of the prior seasonal work permit;
  • the third-country national has a valid passport (validity must be at least three months beyond the intended period of residence in the Republic of Slovenia);
  • the third-country national is covered by appropriate health insurance;
  • there are no suitable unemployed persons in the register of unemployed persons;
  • the employer or hirer is appropriately registered as an employer or hirer, entered in the Business Register to peruse the activities in which the third-country national is to carry out work, or is entered in the Register of Agricultural Holdings as the head of an agricultural holding or a member of a farm household;
  • an employment contract signed by the employer or a civil law contract signed by the hirer is submitted;
  • the employer has settled tax liabilities from work or employment and
  • the total duration does not exceed 90 days in a calendar year;
  • the annual quota of seasonal work permits, which can be set by the Slovenian government due to the limitation of the number of third-country nationals on the labour market, has not yet been reached.

2. Single residence permit for seasonal work longer than 90 days

In the case of employment or work with another employer or contractor, a single permit for seasonal work longer than 90 days may be extended under the same conditions as those applicable to its issuance for the period of the employment or work contract, while the total duration of seasonal work must not exceed six months or, in exceptional cases determined in the Act governing the employment and work of foreigners, seven months in a calendar year.

You must apply for the extension of a permit with the competent authority in the Republic of Slovenia prior to the expiry of the permit.

Appeals

1. Permit for seasonal work for up to 90 days

Appeals against decisions issued at first instance by the Employment Service shall be decided by the Ministry responsible for labour.

2. Single residence permit for seasonal work longer than 90 days

Decisions of administrative units may be challenged before the Administrative Court.

Rights

Change of employment

Consent from the Employment Service to the issuance of the single permit for work is tied to a specific employer or contractor. This means that you cannot change job within the same employer, change employer, or take up employment with two or more employers unless you apply for written approval of the administrative unit, which shall issue written approval in the form of a decision after receiving consent from the Employment Service in accordance with the Act governing the employment and work of foreigners.

In-country application for issuance of written approval is possible.

Application form for written approval

An application for the issuance of written approval shall be made using the form no. 2/1 set out in Annex 1 of the Rules on issuing residence permits, the method of capturing fingerprints and the modalities of the termination of the residence permit.

The form is also available at diplomatic missions or consular posts of Slovenia abroad or at the administrative units in Slovenia.

Change of status

If you wish to change status and reside in Slovenia for a reason other than seasonal work, you may apply for a further temporary residence permit. This must be done before the expiry of the original temporary residence permit.

In-country applications are possible.

Family members

A third-country national residing in the Republic of Slovenia on the basis of a temporary residence permit for the purpose of seasonal work cannot be granted the right to family reunification.

Long-term residence

The period of your residence in the Republic of Slovenia on the basis of a temporary residence permit for seasonal work does not count in the period for issuing a permanent residence permit.
