Seasonal worker in Malta

Are you a non-EU citizen wishing to carry out seasonal work in Malta? You can find information below on the conditions, procedures and rights you can enjoy during your stay.

Conditions

There is no specific scheme in Malta for seasonal workers. General rules apply.

You must obtain:

  • a residence permit on the basis of seasonal work (for stays exceeding 90 days) or a short-stay visa (for stays not exceeding 90 days);
  • if subject to a visa requirement, a visa valid for at least 3 months.

Procedures

Where and how to apply

An application for a seasonal worker permit shall be submitted to Identity Malta Agency in a single application procedure by yourself and endorsed by the employer.

The residence permit will bear a reference to seasonal work and will entitle its holder to stay and work in Malta for a stay exceeding ninety days. For stays not exceeding 90 days, a short-stay visa valid for the duration of their stay in Malta will be issued.

Visa

If subject to a visa requirement, you must obtain a visa at the Embassy or Consulate in your country of origin, prior to your intended arrival in Malta.

Documents required

Residence permit

To obtain a residence permit for the purpose of seasonal work, you must show:

  • a valid contract of employment, or a binding job offer to work as a seasonal worker in Malta with an employer;
  • evidence of having, or of having applied for, sickness insurance;
  • evidence that you will have adequate accommodation or that adequate accommodation will be provided;
  • evidence that you will have sufficient resources to maintain yourself and will have no recourse to the social assistance systems;
  • documentation attesting that you fulfil the conditions for the exercise of that regulated profession.

 

With regards to stays not exceeding 90 days, third-country nationals are issued with a short stay visa and an employment licence indicating that they are issued for the purpose of seasonal work.

To apply for a Jobsplus Employment Licence, your prospective employer must submit the following:

  • Jobsplus Employment Licence Application Form;
  • One original passport size photo, which certifies true likeness;
  • A certified true copy of your travel document (Passport);
  • Processing Fee;
  • A letter from the employer explaining: the need for the position, evidence that the employer searched for Maltese/EEA/Swiss Nationals (except in the field of culture and entertainment) and position description;
  • Your CV;
  • If you are a visa exempt national and a required to stay in Malta beyond your visa exemption, and you are applying for an Employment Licence whilst you are in Malta, on the date of application you must submit a visa valid for at least a further six weeks.
Duration of validity of permitsThe maximum period of stay for seasonal workers is nine months in any twelve month period. After the expiry of this period, you shall leave the territory of Malta.
Appeals

If your application is rejected, a letter of refusal is issued highlighting the reasons.

You may lodge an appeal before the Immigration Appeals Board within three working days from the decision subject to appeal.

Rights

Change of employmentIdentity Malta Agency, in consultation with the pertinent authorities responsible for labour matters, may decide to allow seasonal workers extension of their stay to be employed with a different employer provided that the maximum period mentioned above is not exceeded.
Change of statusYou may change your immigration status if all the relevant conditions are met.
