1. Barriers to removal may be legal, humanitarian or practical in nature or they may results from policy choices. Barriers to return are discussed in the EMN Focussed Study: Returning Rejected Asylum Seekers: challenges and good practices, 2016 .
2. According to section 13.2 of the 'Return Handbook' EU Member States have no obligation to grant a residence permit to non-removable returnees once it becomes clear that there is no more reasonable prospect of removal, but EU Member States are free to do so at any moment.
3. Non-removables include "undesirable and non-removable migrants" who are excluded on the basis of Art. 1F of the Geneva Refugee Convention and Protocol and who may not be refouled because of human rights obligations.
4. Penal sanctions aimed at dissuading non-removable returnees who have no justified reasons for non-return from remaining illegally must comply with fundamental rights, particularly those guaranteed by the European Convention on Human Rights (ECHR) and the Charter of Fundamental Rights of the European Union (CFR), and must comply with the proportionality principle. The maximum time for depriving the liberty of non-cooperating returnees is limited by Council Directive 2008/115/EC (Return Directive) to 18 months.
