Fundamental rights safeguards
Description:
This policy brief examines the growing use of administrative counter-terrorism measures including travel bans, surveillance restrictions or asset freeze, that can be implemented quickly outside the criminal justice process. It argues that while such measures are often justified as flexible tools for preventing terrorism, their expanded use in a context of heightened political polarisation and broadening definitions of security threats risks blurring the boundaries between activism, disorder, extremism and terrorism. The report warns that excessive reliance on these measures can undermine human rights protections, due process and rule-of-law principles, potentially affecting not only targeted individuals but also democratic systems more broadly. It therefore calls for stronger safeguards, oversight and accountability mechanisms to ensure that preventive security measures remain compatible with democratic values and fundamental rights.
